The Terms and Conditions of the Photographic Competition, Storage and Handling of the Photographs
(further stated as “Terms and Conditions”)
1 The Processor of the Photographs and the Purpose of Processing
The processor of the photographs is Masaryk University, Žerotínovo nám. 617/9, 601 77 Brno, Company ID: 002 16 224, a public university operating pursuant to the Act No. 111/1998 Sb., on Higher Education Institutions and on the Amendment and Supplement to Other Acts (the Higher Education Act), as amended. Collected photographs will be processed for the purpose of the use in the project NEWRON, especially in the computer game SAM (Social Activation Module of the NEWRON software). Uploaded photographs will be further considered by the processor in terms of their suitability; all of the uploaded photographs do not have to necessarily become the part of the game.
2 The Statement of the Person Uploading the Photograph
The person who uploads the photograph into the NEWRON project system claims to be the author and/or copyright holder of economic rights of the work. The person who uploads the photograph further claims that no copyright rights of the third parties rights and no personal rights of persons who are captured in the photograph are violated by uploading the photograph. The uploader especially declares that they have the consent of the person in the photo with uploading the photo on the project NEWRON website and with its further use by Masaryk University.
3 The Rights and the Obligations
The person who uploads the photograph agrees with these Terms and Conditions and gives Masaryk University the permission to use the photograph free of charge, non-exclusively, in the full extent possible, in all the ways of possible use of the photograph, territorially, materially and quantitatively unlimited, with unlimited permission to make any changes and modifications, to mix the photograph with other works or parts of work, to create derivative works (even by the third parties), to use the photograph for machine learning and data analysis, all of that for the entire duration of economic rights, and with unlimited right of Masaryk University to grant sublicenses. The person who uploads the photograph grants the Masaryk University permission to publish, share and to use the photo beyond the internal needs of the school. Masaryk University is entitled to change the uploaded photograph and its creative elements and to combine it with other works. Masaryk University is not obliged to use the uploaded photograph.
4 The Rules of the Photographic Competition
The photographic competition takes place in the context of the development of the game under the NEWTON project. The condition for participation in the competition is to upload the photograph in accordance with these Terms and Conditions and to state valid e-mail address of the uploader.
All of the possible competitors who do not act in compliance with these Terms and Conditions breach them are excluded from the competition. Masaryk University as the processor of the photographs and the organizer of this competition is also entitled to decide whether to exclude the competitors, who are suspected of being engaged in unfair, deceptive or dishonest practices. The competitors are no longer entitled to receive any prize nor compensation by the exclusion from the competition.
5 The Consent to Process the Personal Data
By taking part in the photographic competition, the uploader of the photograph hereby grants their consent to process the personal data within the scope of their name, address and e-mail address in order to be contactable during the competition; all the data are granted in accordance with Act No. 101/2000 Sb., on the Protection of Personal Data and on Amendments to some Acts, as amended, for a period of 5 years. The uploader also agrees with a publication of their name at the photographic competition website and Masaryk University website, in particular under the purpose of the announcement of the winners of the competition. Providing such personal data is voluntary. In the case that the uploader is suspecting that the processing of their personal data is carried out in violation of the law no. 101/2000 Coll., they may request correction, blocking or deletion of such personal data.
